These Payment Plan Terms (“Agreement“) govern the arrangement for the settlement of a past due balance owed by Client (“You“) to Vela Wood Staley Young P.C. (“Firm“). By enrolling in the payment plan online, you agree to the following terms and conditions:
1. Enrollment & Payment Method Requirement
You are required to enroll in this payment plan online using one of the following payment methods:
- eCheck (ACH): No additional fee will be charged.
- Credit or Debit Card: A surcharge of up to 3% may apply to each payment depending on your card issuer and applicable state laws.
2. Payment Plan Obligations
You agree to make scheduled payments as outlined in your payment plan. Notwithstanding the term length, the entire remaining balance of your payment plan will become immediately due and payable upon the earlier of:
- The final payment date under the agreed plan; or
- The occurrence of a financial raise of at least $500,000.00 (e.g., debt or equity).
You must notify the Firm in writing within five (5) business days of any such raise.
3. New Invoices Requirement
While the payment plan is in effect, you must timely pay all newly issued invoices from the Firm by their respective due dates. The existence of a payment plan for past due amounts does not suspend or delay your obligation to pay for current or future services rendered.
4. Default and Collections
If any payment under this plan is missed or returned unpaid, or if you fail to pay any newly issued invoices by the due date:
- The entire outstanding balance (including past due and current charges) will be considered immediately due and payable.
- Your account may be referred to a collections agency for further action.
- You shall be responsible for all costs of collection, including but not limited to:
- Reasonable attorneys’ fees
- Court costs
- Any third-party expenses incurred in the enforcement of this Agreement.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to conflict of law principles.
